대한민국 중재 분야의 권위자, 상사중재와 자원봉사활동으로 가치 있는 삶

법정소송이란 대개 모 아니면 도이다. 그러나 현실에서 잘잘못과 가치판단을 무우 자르듯 하기는 쉽지 않다. 금전이나 지적재산권 등이 얽혀 있다면 더욱 복잡해진다. 이에 법원의 판결 없이 분쟁을 해결하는 중재 제도가 솔로몬의 판결처럼 지혜롭고 융통성 있는 제도로 여겨지고 있다. 글로벌 시대, 무역중심 국가에서 필수적인 중재 제도에 대해 일가견이 있는 권위자 김용길 교수를 만나 근황과 함께 정리하는 시간을 가졌다. 

법적조치보다 화해가 먼저. 중재란 무엇인가
중재란 개인간의 사적 분쟁을 자치적으로 해결하는 방안(ADR)으로서, 당사자간의 합의로 선임된 제3자인 중재인이 판정을 하고, 당사자가 그 판정에 구속되기로 합의하는 것이다. 요즈음 연이은 FTA의 체결로 중재 전문가들의 필요성과 권위가 동시상승하고 있다. “법이란 판결 이전에 중재가 전제되어야 한다”는 격언처럼 양자 간에 분쟁이 생겼을 때, 제3자로서 상황을 일목요연하게 객관적으로 꿰뚫어보고 판단한다는 것은 쉽지 않다. 그러나 무역 7대국으로 등극한 우리나라는 수출 및 수입에 대해 많은 분쟁이 필연적으로 생길 수밖에 없으며, 금융계에서도 장기전으로 접어든 론스타 사태를 보면 알 수 있듯 우리나라 안에서가 아닌 해외나 또는 해외 기업 등과 국제적인 분쟁이 생기면 이를 해결해야 하는데, 이는 우리나라 법원의 관할은 아니다.

즉 해외에서 분쟁을 해결해야 할 경우가 많은데, 이 때 뉴욕협약에 따라 세계 공통으로 적용되는 중재는 매우 유용하다. 원광대학교 김용길 교수는 “중재는 개인이 할 수도 있지만 대부분이 기관 중재로서 대한상사중재원에서 하고 있다. 여기에 소속된 중재인은 현재 약 1,100명 정도이다. 중재인은 아무나 될 수 없는 자리다. 중재인의 3분의 1은 부장판사 및 부장검사 출신 이상의 법률 전문가로 선임하고, 3분의 1은 법학전문대학원 교수나 건설, 토목관련 교수 등 이론적 지식과 사회적 위치를 가진 분들을 선임하고, 나머지 300여명은 30여년 이상 현업 실무에 종사한 대기업 및 중소기업 사장과 임원 등 현장 전문가들을 위촉하고 있다.

그리고 200명은 외국 변호사 등 유명한 외국인 중재인들로 구성되어 있다”고 설명한다. IMF 전후로 미국 등 외국을 상대로 소송을 진행하면서 법률 문제와 해당 직무에 대한 전문적인 지식 그리고 영어 구사를 동시에 수행할 수 있는 인재가 부족한 상황이 많았으며, 이러한 문제를 해결하기 위해 도입된 것이 현재의 로스쿨 제도이다. 아울러 이런 분쟁들을 보다 심화하여 해결하기 위한 전문가 집단이 중재인들이고, 중재 판정은 법원의 3심제도와 달리 1회인 단심으로 끝난다. 국제분쟁에 있어서 승인과 집행이 용이한 중재는 소송절차와는 달리 우호적인 분위기에서 분쟁을 해결할 수 있고, 고도의 전문성을 가진 전문가가 합리적이고 공감할 수 있는 판단을 내리는 유연한 제도라 볼 수 있다.  

중재 제도는 개인과 국가를 위한 최선의 장점을 갖춘 제도
중재 제도의 가장 큰 장점은 무엇보다 비용, 시간을 줄이고 당사자가 만나 충분한 상담 및 설명을 들을 수 있기에 사건 해결에 따른 스트레스도 줄어든다는 점이다. 민법 교수로서 민사 분야 판례에 정통한 김 교수는 “판사는 한 번에 여러 건을 해결하는 사람이다. 그러나 중재인은 한 건에만 집중하기 때문에 더 자세히 해결할 수 있다. 대한적십자사에서 백신파동이 났을 때, 환율이 너무 뛰어 백신 납품과정에서 트러블이 생겼었는데 이 때 중재로 해결해 준 적이 있다. 당시에 서로의 이해관계 안에서 최선의 결과를 얻도록 노력했다”고 말한다. 한편 서울지방법원의 법원연계 조정위원으로서 원고와 피고의 분쟁을 잘 조정하는 전문가로 정평이 났다. 2004년부터 대한상사중재원의 중재인으로 활동한 김 교수는 현재 1,900명이 활동하는 사단법인 대한중재인협회의 운영위원 및 지식문화 중재포럼의 대표로 활동하고, 300여명의 회원을 거느린 한국중재학회의 상임이사를 맡고 있다. 덕분에 그간의 활약상 및 대한중재인협회의 자료들을 모아, ‘대한중재인협회 15년사 편찬위원장’으로서 정리할 수 있었다.

그리고 그러한 작업 과정에서 세계 각국의 중재단체에 메일을 보내 편찬 사실을 알리고 그들의 소식을 전하면서 우리의 대한중재인협회를 널리 홍보하기도 했는데 이러한 공로로 2014년에 산업통상자원부 장관상을 수상하기도 했다. 김 교수는 최근에 중국 시장에 주목하고 있다. “원광대학교에 한중법률연구소를 개소했는데, 한중 사업가들 사이에 분쟁이 많았다. 그래서 총장에게 보고하여 관련 전문가를 모아 중국에 진출한 우리나라 기업을 돕고자 하였다.” 또한 김 교수는 국회 입법지원위원으로 위촉되었는데 입법지원위원은 국회의원의 법률안 성안 요구 및 행정입법의 검토의뢰 등 법제 관련 사항에 관한 입법자문을 위해 각계 전문가들로 구성돼 있다. 이는 헌법위반의 개연성이 높은 법률안과 사회적 논란이 있는 법률안, 제정 법률안에 대한 자문 등을 통하여 사회적으로 미칠 영향력에 대해 분석과 연구를 함으로써 사실상 국가 정책 발전에도 이바지하고 있는 것이다.  

봉사 받는 사람, 봉사를 제공하는 사람 사이의 중재인이 되고파  
다른 사람의 말을 잘 들어주고 입장을 배려하는 것이 이성적 영역에서는 중재인으로 나타나듯이, 김 교수는 감성과 배려의 영역에서는 (사)한국자원봉사사회개발원(KVSDI) 이사장으로서 펼쳐나가고 있다. “오랜 고민 끝에 1984년에 산업지원부 소관 경영지도사를 취득하고, 중소기업을 위해 인사, 노무, 경영, 법률 등에 대한 지원을 통하여 자원봉사를 했다. 그리고 2012년에는 한국자원봉사협의회 아카데미가 주관하는 자원봉사관리자 자격증을 땄다”는 김 교수는 전국 240여개인 자원봉사센터와 연계의 중요성에 대하여 언급하면서, 자원봉사에 대한 개념이나 실천방법 등을 정확히 확립할 필요가 있다고 강조한다”. 2014년 12월에 행정자치부 장관상을 수상한 김 교수는 특히 한국자원봉사사회개발원을 세워 청소년들에게 자원봉사활동에 못지않게 자원봉사의 대한 개념과 인식을 바르게 정립시키는 것도 그러한 차원에서다.

“부모들은 자신의 꿈을 자식에게 투영하다 보니 아이들은 자율성이 없게 키워진다. 건전한 멘토시스템의 확립, 그리고 건전한 시민사회를 만들어 청소년들이 보고 자라게끔 하는 것, 또 대학생이 중·고등학생의 멘토가 되는 선순환구조를 만들고 있다”는 김 교수는 아울러 부산 동서대학교 등 연계된 교육계와 산업체와 함께 노동부의 900여개의 직업을 체험시키고, 행정자치부 소관의 비영리법인인 한국자원봉사사회개발원에서 전국 100개 지부를 목표로 활동 중이다. 1개의 지부에 10개의 센터가 소속되어 더욱 체계적인 활동이 기대된다. 건전한 시민사회를 만들기 위해, 법대 교수로서 바람직한 법과 제도를 우리 땅에 제대로 정착시키고 싶다는 김 교수는 사학과 교수들과 협업을 통하여 옛날에 우리 조상들이 경험하고 살아왔던 고대법들을 현대 사회에 응용되도록 하고 싶은 바램을 내비쳤다. 존경받는 큰 어른으로서 김 교수의 행보와 앞으로의 포부가 더욱 기대된다.

Arbitration comes before a legal action
Arbitration is a method to solve personal conflicts autonomously, arbitrated by the arbitrator mutually appointed by both parties of the conflict who are bound to the decision. The need and status of arbitrator is ever increasing thanks to ongoing FTA. Like the saying 'arbitration is a prerequisite for law', it is not easy for an arbitrator to see through the conflict objectively before giving a solution. Korea, as one of 7 trade powerhouses, must happen to have various conflicts relating to import and export. Especially the conflict with a foreign company is out of legal boundary in Korea but to be arbitrated according to New York Convention.

Kim says "a person can arbitrate but most of arbitration is done by the Korea Commercial Arbitration Board. The Board has approximately 1,100 arbitrators and they are all professionals. 1/3 of them are head judges and chief prosecutors, another 1/3 professors at law school or civil engineering and construction, 300 members having worked as board members of major corporations for more than 30 years, and the rest 200 members are consisted of foreign lawyers or arbitrators." Korea actually experienced lack of specialists who can deal with the international conflicts with fluent English after IMF in 1997 but it served as a momentum for the country to introduce current law schools. In this context, arbitrators are a specialist group which deals with the conflicts. Arbitral award is done by only one trial unlike the 3 trial system of the court. Arbitration makes approval and implementation easier in the international conflicts, can be done in a friendly term, and the result is rational and agreeable to both parties. 

Arbitration system as the best system for private and the state
The biggest advantages of arbitration is at lower cost, shorter time and lesser stress than legal battle. As a civil law professor, Kim is an expert at civil cases. He says "a judge is a person who solve numerous legal cases at once but an arbitrator only takes one case at a time and therefore can solve the case more efficiently. I arbitrated the case and solve the case smoothly when Korea Red Cross had a vaccine problem which caused an increase of exchange rate and distribution issues. I drew a satisfactory result for both parties." Kim, as a member of a Mediation Committee at Seoul Central District Court, is also famous for the expertise in solving the conflict between plaintiff and defendant. Kim started to serve as an arbitrator at the Korean Commercial Arbitration Board from 2004, is serving as a Steering Committee member & the representative of Knowledge Culture Arbitration Forum which boast 1,300 members, and as the executive director of the Korean Association of Arbitration Studies which has 300 members. As the Head of Compilation Committee, Kim also published '15 Year History of the Korean Commercial Arbitration Board'. He then let the arbitration organizations in the world know about the Korean Commercial Arbitration Board and the compilation, and he received the prize from the Minister of Trade, Industry & Energy(MOTIE) in 2014 for his contribution. Kim is currently focusing on the Chinese market. Kim says "we opened Korea-China Law Institute at Wonkwang University to solve the conflicts of the businessmen between the two countries" Kim was also appointed as a member of Nation Assembly Legislative Assistance Committee which is consisted of specialists who can assist a thorough screening of proposed law and provide advice on whether the proposed law is against constitutional law or society.

Being an arbitrator between those who serve and served 
Alongside his various roles, Kim is also working as the Chief Director of Korea Volunteer Service Development Institute (KVSDI). Kim says "I obtained a Management Consultant Certificate from MOTIE in 1984 and provided free services on human resource, labor, management and laws. I also obtained a Volunteer Service Management Certificate from Volunteering Korea Academy in 2012." Kim emphasized on the importance of communication between the 240 social contribution organizations nationwide to build effective implementation methods. Kim received the prize of the Minister of Government Administration & Home Affairs in December 2014. Kim says "parents tend to raise their children according to their wants without autonomy of the children. We tried to build a healthy mentoring system in which university students can assist middle and high school students." Kim is planning to provide 900 career experience to students in cooperation with schools and industries as well as opening 100 branches of KVSDI nationwide. One branch covers 10 centers to carry out systematic activities. Kim also hopes to apply our ancient laws to our society in modern terms by working together with history professors.
