“소수 독과점 으로 소규모 재활용 산업 위기”
“폐자원 재활용의 숨통 죄는 규제 개선해야”

현재 100조원 시장이 예상되는, 그리고 미래지향형 중소기업을 위한 국내 재활용업, 즉 자원순환산업의 발전은 박근혜정부의 창조경제가 추구하는 일자리 창출이라는 목표달성에도 도움이 된다. 그러나 실상을 들여다보면 폐기물관리법상의 불필요한 규제들이 원활한 재활용을 가로막고 있는 가운데, 환경부가 제출한 ‘자원순환사회전환촉진법’이 이러한 규제들을 더욱 강화시키고 있다. 폐기물사업 경영진출신으로 민관환경 협의회 자원순환분과에 참여하는 최윤선 부회장으로부터 자원순환 관련 법령의 문제점들을 들어 본다.

재활용이 가능한 폐자원까지 일단 ‘폐기물’이라는 낙인을 찍어
폐기물을 자원으로 만들고 올바른 자원순환을 시키겠다는 대통령 공약이 있었음에도, 여전히 갈 길이 멀다. 종래 정부는 선진국에서 시행되는 생산자책임재활용제도(Extended Product Responsibility: EPR)을 도입하여, 제품 생산자에게 원제품과 포장 등 파생제품을 폐기할 때 일정량의 재활용 분담금을 내게 하는 제도를 시행하고 있다. 하지만 폐가전의 경우, 공제조합 50여개 중 대기업이 포함된 8개 조합이 전체 재활용사업의 4분의 3을 독점하는 분배의 불공정이 존재한다. 게다가 재활용업체에게 생산자분담금을 분배하는 공제조합은 처리비용을 지원받는 재활용사업자들에게 이른바 ‘갑질’을 한다.

최윤선 부회장에 따르면, 폐기물관리법은 방치폐기물을 방지한다는 명분으로 제품 생산과정에서 나오는 부산물이나 소비 후 배출물을 모두 ‘폐기물’로 취급하여 각종 부담금 등 규제 장치 속에 집어넣음으로써 원활한 재활용을 가로막는다. 이는 거래비용과 행정비용을 증가시키고 산업 활성화를 저해한다. 최 부회장은 실제 사업 과정에서 고무와 철심을 분리하는 기술을 고안했음에도 고무 재활용업체가 아니라는 이유로 타이어 공제조합에 가입하지 못함으로서 재활용에 쓸 타이어를 공급받지 못한 경험을 했었다. “규제를 강화시키는 입법은 무늬만 촉진일 뿐 창조경제에 역행한다.”라고 주장하는 최 부회장에 따르면, 재활용촉진법은 규제 일변도의 폐기물관리법이 ‘폐기물’을 매개로 재활용촉진법을 억누르기 때문에 부당하다는 것이다.

전문가들의 의견에 따르면, 폐기물과 별개로 ‘순환자원’ 개념을 유지하고 순환자원에 처음부터 규제의 굴레를 씌우지 말아야 하는데, 폐기물관리법은 모든 재활용품이 폐기물이라는 이유로 “폐기물이 아닌 순환자원”의 존재를 부정한다. 폐기물관리법을 축소시켜 더 이상의 재활용이 불가한 폐기물들만을 관리하도록 하여야 할 것이다. 의원입법으로 국회에 제출된 4개의 자원순환사회 기본법안은 폐기물관리법의 역할을 축소시키고 명실상부한 순환사회로의 전환을 촉진하는 사회체제 재편을 장려한다. 그런데 환경부가 이에 맞서 국회에 제출한 자원순환사회 전환촉진법안은 사회 전반의 재활용에 대한 규제를 푸는 데에는 관심이 없고, 환경부가 중심이 되어 종래의 폐기물 관리법보다 더욱 엄격한 규제체계를 구축하려 한다.

자원순환 사회로의 전환을 오히려 가로막는 정부법안
최 부회장에 따르면, 환경부가 추진하는 자원순환사회 전환촉진법안은 첫째로 우리 사회 전반을 자원순환 체제로 탈바꿈시킨다면서 오히려 정부 중심의 통제 체제를 지향하는 모순을 안고 있다는 것이다. 예컨대, 법안 제9조(순환자원의 인정)는 사회 전반의 자발적 여건 조성을 표방하는 안 제8조(자원순환사회로의 전환을 위한 문화조성)와 상충되는 전형적인 명령통제형 수단이다. 성과관리 대상자별 자원순환 목표를 환경부령으로 설정하고 관리하는 법안 제16조(사업자의 자원순환 성과관리 및 지원) 제2항 및 불이행자 명단공개를 규정한 같은 조 제7항도 마찬가지다. 단순한 행정목표 추구로는 언젠가 임계지수를 넘어서서 장기적인 성과기대가 어렵다.

두 번째로 정부법안은 채무와 책임을 분리시키는 한계를 안고 있다. 예컨대, 법안 제21조(자원순환사회로의 전환을 위한 부담금)는 제1항 제1호에서 시장․군수․구청장을 폐기물처리의무자로 보고 이들이 순환가능 폐기물을 소각․매립할 경우에 폐기물처리부담금을 부과․징수하며, 제4항에서 불이행자에 대하여 가산금을 부과한다는 취지를 규정하고 있으나, 이는 중앙행정기관(환경부장관)이 지방자치단체에 부담금 내지 가산금을 부과․징수하게 함으로써 행정청 간 징벌을 허용하는 사태를 초래한다. 법안 제21조에는 다른 문제도 있다. 폐기물관리법 제14조(생활폐기물의 처리 등)는 특별자치시장, 특별자치도지사, 시장·군수·구청장에게 “관할 구역에서 배출되는 생활폐기물을 처리하여야 한다”(제1항)고 규정하고 있으나, 생활폐기물처리는 배출자의 채무이기 때문에 엄밀히 말해 지자체장의 채무가 아니라 불이행의 패널티를 강요받지 않는 ‘책임’에만 해당한다.

세 번째로 인증제와 순환자원거래소의 강제성은 시장에 의한 자원순환 체계를 근본적으로 저해한다. 정부 법안 제24조(순환자원거래소의 설치․운영) 제3항은 생활계 폐기물 처리책무를 부담하는 지방자치단체에게 순환자원거래소 이용을 강제하고 있다. 이렇게 임의형이 아니라 강제형으로 운영할 경우 당초 거래소 설립 취지와 맞지 아니하며, 행정청에게 이용을 강제토록 요구할 합리적 근거를 찾기 어렵다. 최 부회장은 “이런 통제형 방식보다는 순환자원 개념을 독립시켜 국민의 힘을 발휘하게 함으로써  국가경제에서 재활용이 차지하는 비중을 높일 수 있다”고 힘주어 말했다. 

“선진 외국의 경우를 보면 재활용 박스 외에 또한 Bottle Depo나 대형 마켓에서 국민들이 분리수거해온 캔과 유리병 등을 구매해 주고 있는데, 우리나라도 이런 부분이 더 활성화 되면 구지 비싼 종량제 봉투 속에 아까운 재용 자원을 넣어 소각이나 매립해 버리는 일은 현저히 줄어들 것이다. 또한 그것을 귀찮아하여 종량제 봉투에 넣어버리는 경우가 있다하더라도, 외국처럼 쓰레기통(우리의 경우 종량제 봉투)을 뒤져 재활용 자원을 수거해 Bottle Depo나 대형마켓에 파는 사람들이 활동할 수 있는 여지라도 남겨야한다”는 것이다.

이제는 제약이라는 법적 울타리에서 벗어나, 폐자원 재활용 능력이 뛰어난 우리 국민의 자발적 참여를 최대한 장려할 수 있는 방안의 강구로 소중한 자원이 폐기물로 버려지는 일을 막고 재활용 강국 대한민국으로 나아갈 때라는 생각이다.

"Categorizing recyclable waste resources as 'waste' is wrong"
President Park pledged that she would recycle waste materials but we still have a long way to go. The government introduced Extended Product Responsibility which forces producers to pay part of recycling expenses. But in the case of home appliances waste, 8 out of 50 cooperatives including major companies are monopolizing 3/4 of the recycling project. Those cooperatives distribute the recycling expenses to recycling companies but the problem is that they are being bossy. According to Choi, Wastes Control Act categorizes the by-products and waste made during the manufacturing process as 'waste' to actually prevent recycling in reality. The Act increases trading & administrative costs and hinders the activation of the industry. For example, Choi developed the technology to separate rubber from metal pin but she could not register to a tire cooperative because her company is not a recycling company which means that she could not receive tires for recycling. This means that the Act needs to be revised so that it can function according to its original purpose. Currently, 4 of Resource Recycling Society Acts have been proposed to reduce the role of Wastes Control Act. The problem is that the Ministry of Environment has proposed Resource Recycling Society Promotion Act against the forementioned Acts to introduce more rigid regulations which is an irony.

Government bills that prevent recycling of resource
According to Choi, the Ministry of Environment's Resource Recycling Society Promotion Act is rather swimming against the stream of change by supporting irrational government-centered control. For example, the article 9 (admittance of recycling resource) contradicts with the article 8 (building cultural base for change to recourse recycling society). The paragraph 2 of the article 16 (result management & support of resource recycling) and the article 7 (publicity of defaulter list) are also the same. Pursuing a short term administrative goal does not lead to a long term results. In addition, the government bills separate liabilities from responsibilities. For example, the paragraph 1 of the article 21 (liability amount for change to resource recycling society) appoints mayors and governors to charge and collect the liability amount but the paragraph 4 states that they charge additional fee to defaulters. This means that it allows penalty between the administrative agency. The article 14 (disposal of household waste) appoints the heads of public institutions to dispose the waste in their jurisdiction but household waste is waste producer's liability and therefore it should be categorized as 'responsibility'. Also, the coerciveness of authentication system and Recycled Resources Exchange fundamentally hinders the market resource cycling. The paragraph 3 of the article 24 (installation & management of Recycled Resources Exchange) forces local governments to use the Exchange and this is against its original purpose. Choi says "we have to separate resource cycling concept from control-type systems and this can increase the recycling rate in our society. Bottle Depo or large supermarket chains in the advanced countries buy cans and bottles for people and we need to learn from them to effectively save recyclable materials."
