억울한 일을 당하거나 여러 가지 법률문제로 고심하는 사람들에게 법률사무소는 든든한 동반자이자 희망의 등대와도 같다. 일반 사람들에게는 어렵고 낯설기만 한 법률문제를 해박한 지식을 바탕으로 명쾌하게 풀어주는 전문가 집단의 존재는 불안하고 초조하기만 한 의뢰인들에게 큰 힘이 되어주기 때문이다. 청주를 중심으로 충청지역사회의 법률문제 해결의 이정표로 자리잡고 있는 법무법인 상승의 어수용 대표변호사를 만나봤다.

20여 년간 쌓아온 풍부한 경험
지난 2013년 3월 출발해 2주년을 맞이하고 있는 법무법인 상승은 4명의 변호사가 함께 법률서비스를 제공하고 있다. 외견적인 규모는 작을지 모르나 지역 내의 크고 작은 다양한 사안을 해결하며 중심 법무법인으로서의 위치를 확고히 하고 있는 곳이다.

법무법인의 강점은 일반적인 개인 변호사 중심의 법률사무소에서는 갖추기 힘든 다양한 분야에의 전문지식을 갖추고 있다는 점이다. 어수용 대표변호사는 “저희는 청주 지방법원을 중심으로, 대전, 서울 등의 외지 사건도 많이 다루고 있는 편입니다. 활동의 영역이 제한되지 않고 광범위한 사건을 다룰 수 있는 건 저희 법무법인이 그만큼 민사, 형사, 행정, 가사, 기업 등 다양한 분야에서의 전문지식과 경험을 갖추고 있기 때문이라고 생각합니다”라고 설명했다. 

법무법인 상승을 이끌고 있는 어수용 변호사는 1991년 울산지법에서 법관의 길로 들어선 이래 20여 년간 충청권에서 근무한 지역 최초의 향판(지역 법관)으로, 지난 2012년까지 청주지법 민형사 단독판사, 대전고법 판사, 청주지법 영동 제천지원장, 청주지법 수석부장판사, 대전지법 부장판사 등을 역임해왔다.

20여 년의 법관 생활을 접고 법무법인을 개업한 어 변호사는 현재 윤철호 변호사, 하환희 변호사, 손고은 변호사와 함께 전문 법률서비스를 제공하기 위해 노력하고 있다. 그는 “현재 지방 중소기업의 도산율이 높아지고 있으며 앞으로 이는 더욱 심화될 것으로 예상됩니다. 개인보다는 기업에 관련된 법률서비스가 크게 증가할 것으로 보입니다”라고 언급하며 기업 업무 분야에의 전문성 확립에 방점을 찍고 노력을 거듭하고 있다고 밝혔다.

억울한 이를 구제하는 변호사로서의 책무를 다할 것
법무법인 상승은 기존 법률시장에서 보기 어려웠던 행보를 이어가고 있다. 법률적 조력자로서의 서포트와 함께, 의뢰인이 믿고 의지할 대상이 되어야 한다는 것이 ‘상승’의 설립 목표이자 취지이다. 이와 함께 상승은 사건 유치를 하지 않으며, 특히 법률시장의 부정적 요인으로 작용하며 크고 작은 사고를 불러오는 ‘사건 브로커’는 절대로 상대하지 않는다는 원칙을 세웠다. 눈 앞의 작은 수익에 매달리기보다는 진정으로 자신들을 믿고 찾아주는 의뢰인을 기다리겠다는 생각이다. 어수용 변호사는 “오랜 기간 법관으로 근무했기 때문에 더욱 처신이 중요하다고 생각합니다. 사회 정의를 바로잡고, 억울함을 해소하기 위해선 변호사의 사회적 역할이 매우 중요합니다”라고 밝혔다.

사건 수임에 있어서 법무법인 상승에게 사건의 경중이나, 비용은 두 번째이다. 어 변호사는 가장 중요한 것은 바로 ‘억울함’이라 말했다. 의뢰인이 억울하게 피해를 받게 된 상황이라면 사건의 경중을 가리지 않겠다는 것이 그의 신념이다. 설립 초 겪었던 한 사건의 경우 농촌 주민 다수가 관련됐다는 점에서 많은 시간을 할애해야 하고 그만큼 복잡했지만 수임료는 거의 무료로 진행했었다고 한다.

함께 성장하는 법무법인
어수용 변호사가 법무법인 상승을 이끌면서 가장 중점을 두는 것은 구성원 전체의 역량을 높이는 것이다. 구성원 모두의 역량 강화는 곧 법무법인의 전문성과 업무 능력의 향상으로 이어지며 이는 의뢰인의 만족으로 직결된다는 생각에서다. 그는 “역량 강화는 주로 업무를 통해 이루어집니다. 다양한 업무를 경험하면서 성장하는 게 필요합니다. 저희는 제가 모든 사건에 관여하고 조언을 아끼지 않으면서 제가 가진 경험이 모두에게 전달될 수 있도록 하고 있습니다”라고 설명했다.

사건의 초기단계와 중간단계, 마무리단계까지 경험 많은 대표변호사가 참여하는 이러한 시스템은 다른 법무법인과는 차별화되는 것으로 사건처리에 있어서 보다 노련한 시각과 견해를 더할 수 있다는 점에서 강점을 가진다.  
법률인이 가져야할 사명은 ‘구제’에 있다는 어수용 변호사. 법을 많이 공부하고 배우는 목적은 개인적인 이득이 아니라 억울한 상황에 처한 이들을 구함으로써 정의로운 사회를 구현하는 것이라는 어수용 변호사의 말처럼 수많은 이들이 정당하고 당연한 권리를 찾게 되는 사회가 하루빨리 당도하기를 기다려 본다.

A law office is a reliable partner and like a beacon of hope to those who have been unfairly treated or who have trouble with legal affairs. It is because the existence of a group of experts who work out difficult and unfamiliar legal problems clearly based on their expertise gives great help to the client who has to be worried and anxious. We interviewed representative attorney Lee Soo-yong, of the law firm Sangseung, which is being in place based on Cheongju as a milestone for solving legal problems of Choongchung community.

           
Rich experience piled up for 20 years 
At law firm Sangseung, which started in March 2013, four lawyers are providing legal service together. Though apparently being small in size, it is gaining ground as a central law farm by resolving diverse small and large affairs in the region.

Eoh Soo-yong said, “Centering around Cheongju district court, we are also dealing with quite a few cases of outer places such as Daejon, Seoul, etc. We can deal with an extensive area of cases, not restricted in the scope of activity, because our law firm has been equipped with expertise and experience in diverse fields, such as civil, criminal, administrative, family affair and corporate litigations. 

Attorney Eoh Soo-yong., a leader in the law firm Sangseung, is the first local lawyer who has been working in Choongchung region for over 20 years since he entered into a lawyer from Ulsan in 1991. Until 2012, he has served as a single judge for civil and criminal cases at Cheongju district court, judge at Daejon high court, chief of Yeongdong Jecheon branch of Cheongju district court, senior associate judge of Cheongju district court, and associate judge at Daejon district court. After 20 years of judicial officer’s career, attorney Eoh opened a law firm and is currently delivering professional legal service with lawyers Yoon Cheol-ho, Ha Hwan-hee and Son Go-eun. Mentioning, “Currently, there is an increasing bankruptcy rate of local smaller enterprises and it is going to worsen in the future. It seems legal service related to enterprise rather than person will increase greatly,” he declared that Sangseung is making repeated efforts focusing on establishing expertise in the field of corporate business.

 
Will do his best as a lawyer to relieve those unfairly treated  
Law firm Sangseung is moving differently from others in the existing legal market. The purpose and intention of establishing ‘Sangseung’ is to be a reliable object for clients together with the supporting role as a legal assistance. Besides, Sangseung has a set principle that they never introduce a case or, especially, deal with ‘brokers’ which is a negative factor of legal market bringing about small and large accidents. It is an idea of waiting for clients who rely on truly and visit the firm rather than seeking for immediate small profits. Attorney Eoh Soo-yong said, “As I have served as a judge for a long time, I think I should behave myself the more. A lawyer’s social role is very important, I think, to set social justice straight and relieve unfair treatment.” 

For law firm Sangseung, big or small case or the lawyer’s fee is a secondary element in taking cases. Attorney Eoh said that what matters most is how much ‘unfairly’ the client has been treated. His belief is that if a client has been damaged unfairly, he will not consider whether it is a big or small case. In a case he experienced at the beginning of foundation, he proceeded with a case almost free of charge although it many hours because many of rural residents were involved and so much the case was complicated, he said. 

A law firm building up together 
As a leader of the law firm Sangseung, what attorney Eoh Soo-yong puts focus on is enhancing the capability of the whole members. It is because enhancing capabilities of all members leads to enhancing job abilities, which again leads to the client’s satisfaction.

He explained, “Enhancing capability is chiefly done through duties. It is needed to build up by experiencing diverse business affairs. In our law firm, I participate in all cases sparing no advice and make my experience delivered to all.” Such system, in which the representative attorney with many experiences participate in the initial, middle and finish phases of a case, is differentiated from other law firms and it has strength of adding a more experienced perspective and opinion in handling a case. 

Attorney Eoh Soo-yong says that the mission of a lawyer lies in ‘relief,’ adding that the purpose of studying and learning law is not a personal gain but to realize a just society by relieving those put in unfair situations. Like he says, it is highly expected that a society where numerous people recover their just and natural rights will arrive soon.
