기업의 회생·파산 분야에서 주로 경력을 쌓아온 박병건 변호사는 최근 전북 전주시 법원앞에 신세계 법률사무소를 개소하고, 대표변호사로서 전주, 군산, 익산 등 전북지역을 아우르는 본격적인 변호사 업무에 돌입했다. 그는 전북지역 내에서 6명밖에 없는 전주지방법원 논스톱 국선변호인으로 선발되어 활동하고 있으며, 형사 사건을 비롯한 가정폭력, 이혼, 아동학대, 노인폭력 등 가사사건과 채권채무관계 등 그밖의 다양한 민사사건을 도맡아 처리하고 있다. 

박 변호사는 최근 성범죄자로 지목된 피고인의 억울한 사연을 무죄판결로 이끌어내면서 화제를 모았다. 남원의 한 사찰의 신도였던 건축업자가 해당 절에 거주하고 있는 보살을 강간했다는 혐의를 받고 유력한 용의자로 지목받았던 사건이었다. 소재가 자극적인 편이어서 사회적 이슈가 되었고, 성범죄 특성상 증거가 많지 않고 피해자 진술을 중심으로 심리가 진행되기 때문에 무죄를 받는 것은 쉽지가 않은 상황이었다. 

그는 먼저 해당 사찰의 주지스님과 보살이 검·경찰에 진술한 내용중에 잘못된 부분은 없는지 번복한 부분이 있다면 어떤 부분인지 먼저 꼼꼼히 살펴보았다. 그리고 해당 주지스님의 사업채무 등 사실관계를 파악하고, 다른 스님 등 목격자나 증인확보에 주력했다. 또한 판사·검사 등이 공식적으로 참석한 현장검증 자리에서 피해자 방과 옆방은 평상시 말소리도 들릴만큼 소리가 잘들린다는 점을 입증하고, 옆방에 거주하고 있던 스님이 사건 당일 아무 소리도 듣지 못했다는 증언을 받아내기에 이르렀다. 이 과정만도 1년 가까이 소모된 쉽지 않은 싸움이었지만 결국 구속영장 기각과 1심 무죄, 항소심과 대법원까지 무죄를 얻어냈고 무죄를 확정지었다. 

“의뢰인의 목소리에 귀기울이고 성실하게 노력하는 변호사가 되는게 제 목표입니다” 통상적으로 변호사 업무량이 적지 않다보니 사무실의 사무장이나 직원에게 사건을 맡기는 경우도 많지만, 박 변호사는 항상 직접 도맡아 처리하는 것이 원칙이다. 당연한 얘기임에도 지켜지지 않는 것들을 누구보다 먼저 성실히 지켜나가며 신뢰를 쌓아가겠다는 박 변호사의 의지는 젊은 패기이고 도전이기도 하다. 그는 항상 사회적 약자의 시선에서 안타깝고 억울한 사연들을 마음으로 공감하며 업무를 진행한다. 

얼마전 담당했던 한국인 남자에게 시집온 베트남 여성이 가정폭력에 시달리다가 오히려 이혼당할뻔한 사연도 그랬고, 단지 통장을 빌려주었다는 이유만으로 1억8천여만원의 거액을 청구당한 어느 가난한 가장의 사연 역시 그랬다. 결국 베트남 여성은 위자료 2천만원을 비롯해 양육권과 양육비를 받게 되었고, 뜬금없이 거액을 갚으라고 청구당했던 남성의 사건도 기각되어 억울한 사연없이 잘 해결되었다. 

박 변호사는 “같은 사건일지라도 판사의 관점에 따라 생각지 못한 방향으로 심리가 진행될 수도 있기 때문에 변호사가 필요하다”며 “변호사가 얼마나 사건에 관심을 가지고 진심으로 대하는지 여부가 사건 해결에 있어 가장 중요한 것 같다”고 전한다. 의뢰인의 억울함과 고통을 해소하기 위해 최선을 다하는 그는 언제나 매 사건마다 진정한 관심과 진심을 녹여내기 위해 노력한다.

박병건 변호사는 동암고를 졸업하고 전북대 법학과를 수석졸업했다. 이후 전북대 법학전문대학원 법학전문석사 3기로 차석졸업했으며, 법무법인 대언에서 2년 9개월동안 변호사로 활동하고 현재 법률사무소 신세계의 대표변호사로 자리잡았다. 현재 고려대 형사법 전공 박사과정을 수료중이며, 전주지방법원 국선변호인·국선보조인, 전라북도 법률고문변호사, 전주덕진경찰서 수사민원상담센터 상담위원, 전북대 공공인재학부 강사, 동암고 학교폭력자치위원회 전문위원 등을 역임하고 있다. 대외활동으로는 한전주라이온스클럽과 서전주JC클럽, 결식아동을 위한 모임, 유니세프 등에 가입해 사회봉사 및 기부에도 적극적으로 참여하고 있다.

Attorney Park Byung-geon, who has made a career mainly in the field of corporate turnaround and bankruptcy, recently opened Shinsegye Law Firm in front of a law court in Jeonju, Jeonbuk, and entered into working as a lawyer covering Jeonbuk area including Jeonju, Gunsan, Iksan, etc. He is in service being selected as nonstop court-appointed lawyer at Jeonju District Court with five others representing the whole area of Jeonbuk. He is in charge of family violence, including criminal case, family dispute such as divorce, child abuse and conjugal violence in the elderly, and credit-debt relations and other diverse civil cases. 

Recently, attorney Park drew attention by obtaining a sentence of innocence from a case involving the accused pinpointed as sex offender. It was a case where a builder and believer at a Buddhist temple in Namwon fell under suspicion of raping an old female believer who lived in the temple and pinpointed as prime suspect. With this sensational topic, this case became a social issue but it was hard to win the verdict of innocent because, with few proofs, a characteristic of sex crime, trial proceeded focusing on the victim’s statements. 

He first examined closely whether there was wrong in the statements told by the temple’s chief monk and old woman believer to the police and prosecutor and what part of their statements was changed if any. Then he checked the facts including the monk’s debts from business and directed energies toward securing eyewitnesses including other monks. Besides, in the sitting of on-the-spot inspection officially attended by judge, prosecutor, etc. he proved that usually, between the victim’s and the next room, even a whisper was clearly heard and then obtained the testimony that a monk residing in the next room didn’t hear anything on the day of the incident. This process alone was a struggle taking almost a year but he obtained a rejection of arrest warrant, innocent at the first trial, then at second appeal trial and at the Supreme Court, establishing the verdict of not guilty. 

“My aim is to become an attorney who makes a sincere effort by listening to the client.” Usually, with many workloads of the attorney, there are many who entrusted a case to the office manager or staff in the office but attorney Park makes a rule to take charge of things in person. Attorney Park’s will is both a young spirit and challenge when he says that he will keep to just things which are not observed sincerely before any others and build up confidence. He always proceeds with cases with regrettable and unjust stories in sympathy putting himself in the place of the socially weak. 

Some time ago, he dealt with the story of a Vietnamese woman married to Korean almost being divorced after suffering family violence and a case of a poor patriarch who was charged with a large sum of 180 million won simply because he had lent his bankbook, In the end, the Vietnamese woman received 20 million won as consolation money plus child custody and fostering expenses while the case of the man who had been charged with a large sum for no substantial reason was rejected, working out well leaving no unjust result. 

Attorney Lee says, “Even at the same case, the trial may proceed in an unexpected direction depending on the judge’s viewpoint, which makes an attorney necessary, How much an attorney pays attention to the case treating it with a sincere heart seems to be the most important in resolving a case.” He is doing his best to relieve the client’s unjustness and suffering and always making endeavors to pay a sincere attention and true heart at every case. 

Attorney Park Byung-geon graduated from Dongam High School and from Jeonbuk University, majoring in law, first on the list. Then he graduated from Jeonbuk University graduate school of law third on the list as the third bunch of masters. He worked for the law firm Daeeon for three years and nine months as a lawyer and settled down as representative attorney for the law firm Shinsegye. Currently, he is on the doctor’s course for criminal law at Korea University serving as court-appointed lawyer and assistant at Jeonju District Court, legal advisor to Jeonjuk, counselor at Jeonju Deogjin Police Station’s civil appeal counseling center, Jeonbuk University instructor (for science of public talents) and Dongam High’s committeeman for school violence self-rule. He has also subscribed to Hanjeonju Lions Club, SeoJeonju JC Club, Meeting for the poorly-fed children, UNICEF, etc. positively participating in social service and donation.
