Prof. Kim suggest a new Constitution of Dual executive system(Semi Presidential System like French Constitution) for Korea - Prime Minister for managing internal affairs and President for consolidating public will by strengthening his/her right for national defence and unification. 
‘The National Assembly Committee Rule Filibuster Act’ - which prevents passing the law when failed in gaining the vote by 3/5, even it is submitted by the president - and ‘filibuster’ put a stop to 19th National Assembly on hold. This is the political picture in March 2016 Korea. The Constitution of the Republic of Korea was established in July 1948, revised in 1987 in negative consideration of the deceased former president Park’s Yushin Constitution and has been kept as it is ever since. Prof. Kim has studied Korea’s constitution for the last 60 years and has worked on explaining them easily to the people. Kim particularly focuses on how the laws should be applied to politics and our daily lives. The National Assembly Filibuster Act, for example, is against the constitution and prevents president’s policies and bills from passing according to Kim. There is no room for the public to ask about the right or wrong of president’s policies and duties because he/she might shift the responsibility to either or both ruling and opposition parties who vote against his/her will. As a solution, Kim has suggested a system that the president takes responsibility on diplomacy, national defence and unification in mid and long term policies while the prime minister, with the help of the cabinet and majority lawmakers, takes care of internal affairs such as economy, security and social policies. Kim calls this as ‘dual executive system’. Kim also emphasized on the importance of a system that President can either dissolve the cabinet or the National Assembly when the National Assembly pass a vote of nonconfidence of cabinet in president, so that the people can choose either the National Assembly or the government through a election.

Establishing practical constitutional amendment and unified constitution
Prof. Kim, a member of the Korea National Academy of Sciences, introduced ‘Unified Korean Constitution’ last year after a thorough study and research. Kim hopes that it can be used in harmony with ‘New Constitution’ made two years ago by the National Assembly Advisory Committee of Constitutional Amendment. In terms of the problem whether we see the North as a State or not, Kim said that our constitution clarifies that the ROK is the sole constitutional State in the Korean Peninsula and we can just regard the North not a State but a part of our territory or an autonomous region which we have to deal with for unification.

No People’s popular sovereignty!
The assertion for people’s sovereignty is a breach of the Korean constitution. The Constitutional Court’s interpretation on dissolving the Unified Progressive Party is justified based on the Article 8 Paragraph 4 of the Constitution ordering dissolve undemocratic Communist political party. In other words, it is ‘sovereignty of the nation not ‘sovereignty of a certain group of people’ - such as laborers or working class. It is constitutional if laborers win more than 2/3 of the vote at the general election and amend the constitution in the democratic way but the blind pursue of the North’s ‘Juche Idology (self-reliance ideology)’, which seem to mix monarchy with the Japanese Emperor System but not at all a socialism, is clearly against our constitutional law and order. The North’s only ask ‘yes’ or ‘no’ for the already appointed candidates and things are ruled by the one man only itself, even though there are diplomatic heads, which we call this as autocracy or dictatorship.

More people should have knowledge of the law
Until Year 2000, up to 20,000 law students graduated annually with a few passing the bar exam. And those who failed the bar exam took a position in administrative institutions or private companies and practiced legal knowledge. The recent law school system however is causing a significant reduction in number of law students. Kim advised that a law student being well-acquainted with the vast knowledge of the law in 3 years is impossible but studying law for 4 years and move on to a master course to build lawyering ability like Japan might be an ideal alternative. Law schools provide limited seats and the passing rate of bar exam is low. Building experience as a lawyer for 10 to 20 years and then move on to judge’s position like the US is more advisable than move directly from lawschool graduate to prosecutor like Korea. Kim also pointed out that our system in which the rank and the order between the judges affect the verdict must be improved. With his 60 years of expertise in constitutional study and teaching, Kim defines that the implementation of the constitution is about promoting public interest and rendering social justice over one’s selfish interests and desires. Korea’s top-down culture, even prevalent in administration and the National Assembly, also makes it really hard for law students to put their knowledge and inspiration gained at school in practice. Power Korea hopes that more people will know about Kim’s accumulated knowledge and positive solutions to upgrade our legal system.
