우리나라의 산업화 자본주의 경제는 빠른 성장을 거친 만큼 80년대 이후부터 지속적으로 여러 가지 어려움들을 맞닥뜨려 왔다. 그 중 가장 대표적이라 할 만한 것이 바로 ‘공정거래’와 관련된 여러 가지 이슈다. 특히 산업화 초기에는 기업의 수출경쟁력을 높이기 위해 정부 차원에서 일부 기업에게 재정․금융상의 지원을 한 결과 독과점 시장이 형성되었다. 노동 집약적인 산업 환경 속에서 어느 한 쪽에 부가 편중되기 쉬운 경제구조를 가진 우리나라는 특히 ‘공정거래법’이라는 제도적 규칙이 더욱 명확한 질서를 바로잡아야 할 필요가 있다. 공정거래법 전문 변호사인 법무법인 태평양 오금석 변호사는 국내외의 다양한 공정거래 관련 이슈를 도맡아 처리하는 국내 대표 변호사다.

2004년부터 법무법인 태평양에서 공정거래팀 업무 시작해
서울대학교 법과대학 법학과 졸업 후 군대에서 군법무관으로 활동하며 서울대학교 법학대학원 세법 전공 석사학위를 취득한 오금석 변호사는 제대 후 1992년부터 서울지방법원 북부지원 판사로 임관하여 1994년 서울지방법원으로 전원하는 등 판사로의 경력을 시작했다. 이후 춘천지방법원 속초지원으로 근무지를 옮겨 양양군 선거관리위원회 위원장, 고성군 법원 판사 등을 겸임했고, 콜롬비아 로스쿨 비지팅스쿨 1년 과정을 마친 후에는 대법원재판 연구관으로서 활발한 활동을 이어갔다.

군법무관을 포함해 15년 간 공직생활을 하던 오 변호사가 지금의 길을 걷게 된 것은 2004년 3월 법무법인 태평양에서 조세사건, 민․형사 상고사건, 공정거래 일부 사건 등을 맡은 변호사가 되면서부터였다. 공정거래, 조세소송, 행정소송, 헌법소송 등을 전문분야로 하는 오 변호사는 뛰어난 실적을 보이며 공정거래업무 전문 독립 부서에서 활동을 계속해 나갔다. 법무법인 태평양의 공정거래팀은 발족 당시에만 해도 5명 규모의 작은 팀이었지만, 오 변호사와 함께 팀원들이 꾸준히 실적을 보인 결과 현재는 30명 정도의 규모로 성장해 국내외 유수의 기업들과 함께 일하고 있다.

또한 법무법인 태평양은 2009년 6월 국내 로펌 최초로 재단법인 동천을 설립하여 난민, 장애인, 여성, 청소년 등에 대해 다양한 공익법률지원활동 등 공익활동으로 2014년 국가인권위원회 대한민국인권상을 수상하며 법무법인의 사회공헌활동을 이어나가고 있다.

국내 공정거래 분야 독보적인 실적 보유해
변호사 업무를 시작한 2004년부터 오 변호사는 국세청 조세법률고문, 공정거래위원회 사건처리절차개선 연구회 연구위원, 서울대학교 법학연구소 경쟁법센터 운영위원 등으로 활동하며 국내 공정거래 분야에서는 독보적인 위치를 차지하게 되었다.

현장에서의 활동도 게을리 하지 않은 오 변호사는 기업결합(M&A)에 반대하는 회사를 대리하여 일했던 경험을 가장 인상적인 기억으로 꼽았다. “호주 철강회사 BHP가 Rio-Tinto를  결합하려 한 사례가 있었다. 나는 일본 제철회사 Nippon Steel 등 5개 회사를 대리해서 한국공정위에 ‘호주철강회사들의 기업결합이 한국시장과 일본시장에 영향을 미치기 때문에 기업결합에 반대한다’는 입장을 대변하였다. 변론에 열심히 임한 결과 한국공정위도 문제점을 인정해 기업결합을 반대하는 심사보고서를 작성하여 결국 호주철강회사들이 결합을 중단한 사례가 있었다”

오 변호사는 그 밖에도 (주)호텔롯데의 AK면세점 인수 건에서 (주)호텔롯데를 대리하여 경쟁사들의 반대에도 불구하고 조건 없는 승인을 취득해낸 바 있으며, 미국 e-Bay의 지마켓 인수 시 지분 매도인인 인터파크를 대리하여 공정거래위원회 시정조치의 대폭 감경을 유도했다. 또한 일본 샤프㈜와 LG전자㈜ 등 LCD 패널제조회사들의 LCD 패널 담합 사건에서 위 2개 회사를 모두 대리하여 샤프㈜에 대하여는 심의절차 종료를 이끌어 내고 LG전자㈜에 대하여는 과징금부과처분을 취소받기도 하였다.

‘대규모 유통업법 이론과 실무’ 등 다수 저술해
“기회를 스스로 찾아가라” 조언
오 변호사는 ‘공정거래법 위반사건에 대한 심의준비절차 시범실시의 성과와 보완과제’(경쟁저널, 2006)를 비롯해 ‘대규모 유통업법 이론과 실무’(박영사, 공저: 오금석 외, 2012) 등 다양한 저술 활동과 함께 2008~2010년 사법연수원 민사 변호사실무 교수, 2014~2015년 사법연수원 특별변호사실무 교수 등 현장을 함께 지휘하게 될 후배들을 양성하는 과정에도 열과 성을 다해 참여하고 있다.

그는 “후배 변호사들에게 ‘기회가 올 때까지 기다리지 말고, 스스로 찾아가라’는 말을 당부하고 싶다”고 전했다. 그가 활동하는 공정거래 분야는 한 번 지식을 익혔다고 해서 끝나는 분야가 아니다. 점차 현대화되는 경제 환경 속에서 처리해야 할 문제는 늘어가고 항상 새로운 상황을 맞닥뜨려야 한다. 그러나 항상 최전선에서 열심을 다해 변호에 앞장서는 그가 있기에, 대한민국 경제의 혁신이 완성될 수 있을 것이라 할 수 있다.

Oh’s career as a lawyer in Fair Trade Department of BKL since 2004
Lawyer Oh graduated from Seoul National University School of Law, served as a military judicial officer when in military service and obtained a master’s degree in tax law at the same law school. He then served as Judge of Seoul Northern District Court from 1992 and moved to Seoul District Court in 1994 on the same position. He again moved to Chuncheon District Court in Sokcho and served as Judge of Goseong County Court and also Chairman of Yangyang County Election Committee. He finished the one year course of Columbia Law School’s Visiting School and served as a judicial researcher at the Supreme Court when he came back to Korea. Then on the occasion of taking a tax case, appeal cases and part of fair trade cases of BKL in March 2004, he started his career as a lawyer. Oh worked as a specialist in lawsuits of fair trade, tax, administration and constitution and showed an excellent performance and finally, landed in the current Fair Trade Department of BKL. There were only 5 lawyers in the fair trade team but they have grown to be boasting 30 lawyers now. BKL founded ‘Dongchun’ in June 2009, first in history of the Korean law firm. It provides free legal supports for refugees, disabilities, women and youth and for its contribution, received The Human Rights Award of Korea last year from National Human Rights Commission of Korea.

Oh gives top performance in fair trade issues in Korea
Apart from working for BKL, Oh has served as a tax judicial counselor for National Tax Service, researcher of Case Procedure Improvement Study Group of Fair Trade Commission and committee member of Competition Law Center of Seoul National University Legal Institute. Lee introduced one of his memorable cases in which he worked on behalf of a company against M&A. “The Australian steel company BHP tried to merge Rio-Tinto. As the legal representative of 5 companies including a Japanese steel company Nippon, I delivered to Korea Fair Trade Mediation Agency their messages of disapproval against BHP’s M&A attempt as it would affect Korean and Japanese markets negatively. The result was we won the case and BHP gave up its plan.” Oh also won a case for Lotte Hotel in regard to taking over AK duty free shops, and for Interpark in regard to e-Bay’s acquiring shares of Gmarket. In addition, Oh worked on behalf of Sharp and LG in regard to LCD panel price fixing and drew a termination of inspection procedure for the former and a cancelation of imposition of penalty surcharge for the latter. 

Publishing ‘Theory & Practice of Large Scale Distribution Law’
“Take initiative in finding opportunity” 
Meanwhile, Oh wrote several books including ‘Achievement & Complementary Tasks of Test Operation of Review Preparation Procedure on Infringement of Fair Trade Law (2006)’ and  ‘Theory & Practice of Large Scale Distribution Law (2012)’. Oh also showed a great interest in fostering talented students by serving as a professor of Civil Cases Lawyer Practice from 2008 to 2010 and Special Lawyer Practice at the Judicial Research & Training Institute from 2014 to 2015. He says “My advice to my junior lawyers is ‘Take the initiative in finding opportunity rather than waiting’.” With knowhow, experience and professional knowledge in law and fair trade in particular, Oh is a highly expected lawyer to contribute to raising the status of the Korean legal system and competitiveness.
