교계 최초로 ‘김영란법 시행세칙’ 제정
교회․교인이 준수 실천할 윤리강령…본문 38조 및 부칙

대한예수교장로회 분당중앙교회(담임 최종천 목사)는 지난 2월 26일 정기공동의회를 열고 본문 38조, 부칙 3조로 구성된 ‘청탁금지법(일명 김영란법)에 관한 분당중앙교회 시행세칙’ 을 제정, 공포했다. 최종천 목사가 담임하고 있는 분당중앙교회의 ‘김영란법 시행세칙’은 한국 기독교계에서는 최초로 만들어진 것이다. 최종천 담임목사를 만나 청탁금지법, 일명 김영란법의 제정 배경과 내용 요지, 한국교회에 주는 파급 효과 등을 들어 보았다. <편집자 주>   

교회사역 공정성․ 투명성 제고에 기여"
최종천 목사는 ‘청탁금지법 시행세칙’을 제정하게 된 그간의 경과를 설명했다.  “정부가 지난해 9월 28일 ‘부정청탁 및 금품등 수수의 금지에 관한 법률’(약칭 ‘청탁금지법’)을 시행함에 따라 이를 교회에 적용할 수 있는 세부기준과 절차를 정하기 위해 만든 것”이라며, 교회 최고의사결정기구인 당회의 결의와 교인총회인 공동의회의 인준을 거쳐 2017.2.26. 최종 확정한 것이라고 밝혔다. 
최 목사는 “정부가 지난 해 9월 28일 ‘김영란법’을 시행한 이후 분당중앙교회는 ‘교회 시행세칙’ 제정을 위해 교회 자체적으로 초안을 작성한 뒤, 법률전문가․법무법인 ‘로고스’의 전문변호사 자문과 검토를 거쳤고, 국민권익위원회가 공개한 ‘청탁금지법’에 관한 해설과 Q&A자료 등을 참고했다”고 소개했다. 
최 목사는 분당중앙교회가 ‘청탁금지법에 관한 시행세칙’을  만들어 교회에 적용할 수 있는 기준을 교회 최초로 제정하여 한국교회 앞에 제시하게된 것은 “교회사역의 공정성과 투명성 제고에 더 큰 유익으로 승화될 수 있다는 점에서 큰 의미를 함축하고 있다”고 밝혔다. 이번 시행세칙의 성격에 대해 “정부의 ‘청탁금지법’ 내용을 충실히 반영하고 있고, 입법취지 및 그간 활발하게 논의되어 합의로 도출된 사항들을 균형 있게 반영하였다“고 평하면서, 최 목사는 실제로 한국교회가 적용해나간다면 매우 유익한 지침으로서 역할을 다할 것이라고 그 의미를 부여했다.

“교회의 선제적 준비 필요한 때
 사회설득과 친화 계기 마련해야"
최 목사는 이어 “청탁금지법이 교회와 관련하여 적용될 때, 내용을 정확히 파악하지 못하면 본의 아니게 교회나 관련자들이 법적 어려움을 겪고 사회와의 괴리를 가져올 수도 있다”고 말하면서 교회가 선제적 준비를 하고 이를 통해 사회설득과 친화의 계기를 마련하는 노력이 어느 때보다도 중요하다고 강조했다. 
최 목사는 덧붙여 ‘시행세칙’에 담겨진 내용이 교회 중심으로 발생할 소지가 있는 대부분의 경우를 망라하고 있어 교회와 소속 교인들이 ‘청탁금지법’으로 인해 빠질 수 있는 교회내 어려움 극복에 도움을 주게 돼 무엇보다도 기쁘다고 했다. 최 목사는 이번  ‘시행세칙’이 한국교회에 함께 나누어져 각 교회발전에 보탬이 되고, 목회자들에게는 목회의 유익을 구하는 일에 선한 도구로 사용되어 그 영향력이 발휘되었으면 좋겠다는 소망을 피력했다.
최 목사는 이번 ‘시행세칙’이 교회가 바른 신앙공동체 형성과 대내외 신뢰성 제고를 위해 교회와 소속교인이 준수하고 지켜야할 윤리강령으로 제정된 것이라고 하면서, 교회와 소속교인이 양심과 윤리에 어긋나지 않도록 하기 위해 제정하는 준칙(準則)이라고 덧붙였다. 최 목사는 ‘시행세칙 준수의 의무와 책임’에 대해 △신앙의 원리 보존과 신앙공동체 질서 유지에 기여, △부정청탁과 금품 등의 제공 및 수수를 용인하지 않는 풍토 조성, △교인은 교회의 거룩함과 성결 유지에 솔선수범, △교회와 교인 모두가 불이익을 당하지 않도록 노력해야 한다는 점을 꼽았다.

강사 사례 등 각종 지급규정 명문화
최 목사는 교회가 행하는 ‘협찬’과 관련하여 “정당한 권원이 있는 경우”에는 당회의 승인을 거쳐 허용될 수 있다고 했다. 또, 교회에서 강사로 초빙하는 목사 등의 설교는 “교인을 대상으로 의견․지식을 전달하는 외부강의로 간주한다”고 했고, 특히 교회에서의 특별공연과 찬양대 특별찬양시 행하는 연주․공연이 사실상의 문화예술행위로 “사례금 수수 제한을 받는 외부 강의에 해당하지 않는 것”으로 규정했다고 밝혔다. 
최 목사는 △당회 승인을 거쳐 신학교 교수 등 협동목사를 임명할 수 있고, △협동목사는 교회가 정한 ‘사역약정계약’을 체결해야하며, △교회가 정하는 바에 따라 설교 등 사역에 참여하고, △교회가 고정사례비를 지급할 수 있도록 했다며, 교회사역에 유급으로 사역하는 성가대 지휘자와 반주자, 악기연주자, 솔리스트 등에 대한 사례비는 “정당한 권원에 의해 지급되는 것”으로 하는 것으로 간주해 사례비를 지급토록 했다고 밝혔다.
언론 등 광고와 관련해서는 언론과의 계약에 따라 광고를 게재하고 광고료를 지급하는 행위를 허용하고, 후원 또는 협찬에 따른 언론에서의 기사 게재 시 광고성 기사임을 명시하도록 했다고 말했다.   
이번 분당중앙교회가 2017.02.26. 정기공동의회에서 만장일치로 의결 공포하여 시행중인 ‘청탁금지법에 관한 분당중앙교회 시행세칙’은 △제1장 총칙, △제2장 부정청탁행위 등의 금지 및 제한, △제3장 금품 등의 제공 및 수수행위의 금지 제한, △제4장 외부강의와 사례비 지급 등, △제5장 교회발전과 목회유익을 위한 적용기준 등을 담고 있다.

2백쪽 넘는 ‘교회법규집’ 자체 보유 
한편, 분당중앙교회는 교회가 어려움을 겪은 이후 교회운영정관, 재무회계처리에 관한 시행세칙을 비롯하여 각종 규정과 규칙, 기준과 지침 등 30여개에 달하는 200여 페이지 분량의 교회 자체법규를 당회 및 공동의회 승인을 거쳐 제정하고, 담임 최종천 목사의 ‘교회위기관리론’ 책자 발간 등 이를 한국교회에 전파 확산시키는 노력을 기울여 왔다. 특히 최 목사는 교회위기관리를 중심으로 교회재정의 3대 원칙(적법성, 절차의 정당성, 공지)과 예결산 관련 3대 사항(예산의 확보, 집행, 결산)등 재정 관리의 투명성 제고, 내년 1월부터 시행되는 종교인 납세 등과 관련된 현안 해법들에 관해 각 교단과 노회 목회자포럼 등의 초청을 받아 특별강의와 강연을 지속적으로 실시함으로써 한국교회와 목회자들에게 많은 도움을 주고 있다.

Securing transparency and fairness of Korean church

"The National Assembly passed Kim Young-ran Act on 28 September last year and we introduced bylaws of the Act through the committee and the common assembly of the church on 26 February 2017 in order to secure transparency and fairness of Korean church" explained the head pastor Choi Jong-chun of Boondang Central Presbyterian Church and he continued "We invited LOGOS, a law firm, for advice and review for the bylaws and used explanation and the Q&A of the Act as reference. We gathered our will to strengthen transparency and fairness of Korean churches with the bylaws of Anti-Bribery and Graft Act as the foundation and they reflected items of understanding of the meetings we have had so far."

"Korean churches need to get closer to society"

"It is really important for the officials of churches to understand Anti-Bribery and Graft Act as they are likely to get surprises by the law and suffer from legal consequences otherwise. Churches in fact need to take the initiative in spreading the act to the people in our society" said pastor Choi. He added that the bylaws of the act covers most areas that are related to church administration and they would be used as a comprehensive guide for both church workers and believers. Some of the articles of the bylaws on 'duty and responsibility' Choi pointed out are △ following the principle of the Bible and maintaining the communities of believer △ refusing any act of bribery and graft △ taking the initiative and setting an example △ cooperate endeavor to follow the bylaws so that none of believers is dishonored by the act.

Stipulating payment regulations 

Regarding 'sponsorship', Choi said that it can be done when it has 'the ground of claim' through the committee. Regarding 'invitation of lecturers', Choi said "they must be categorized as out-side lecturers who deliver opinions and knowledge to believers" and regarding 'performance and concerts', "they are not categorized as out-side lectures which have limited acceptance of money." Choi pointed out △ appointment of professor of seminaries and associate pastors must be done through the approval of the committee △ associate pastors must sign on 'missionary agreement' △ associate pastors must participate in missions as provided by the church △ the church is the body to pay fixed honoraria. The conductor of the choir, instrumentalists and soloists of the church, for example, must be paid on 'the ground of claim'. The church can also pay for commercials on media through a contract with clear statement on the article that it is a commercial. The bylaws of Anti-Bribery and Graft Act of Boondang Central Presbyterian Church is consisted of △ general provisions (chapter 1) △ prohibition and limitation of bribery and graft (chapter 2) △ prohibition of giving and receiving money (chapter 3) △ payment for out-side lectures and reward (chapter 4) △ application base of benefit and development of the church.

A book of 'church laws and regulations'

Boondang Central Presbyterian Church has its own book of 'church laws and regulations' covering 200 pages of 30 areas to guide management and administration of the church. Choi also personally published his book 'Church Crisis Management' which is being actively spread to many churches for the use of reference. Choi's three principles of church budget (legality, legitimacy of process and openness) and the three articles (securing budget, execution and settlement) are very popular that he is constantly asked for lecture from various churches and church organizations. In the lecture, he is also giving his knowledge and advice on the law that forces religious groups to pay tax starting from January next year. <Power Korea> sends a message of support.
