헌법재판소, 박근혜 전 대통령을 파면하다
지난달 10일 8인 만장일치로 전원 인용해

2017년 3월 10일 오전 11시. 대한민국은 숨죽인 채 헌법재판소의 박근혜 전 대통령 탄핵소추에 대한 결과 발표를 기다리고 있었다. 작년 10월부터 반 년 이상 지속되어온 국정농단 사태와 탄핵 정국으로 대한민국은 유례없는 혼란을 겪고 있었다. 그리고 20여 분의 선고 끝에 헌법재판소 재판관 8인의 만장일치 인용으로 박근혜 전 대통령이 파면되었다. 이날 안국동 탄핵반대 집회에서는 부상자 및 사망자가 발생하기에 이르렀으며, 결국 지난달 12일 박근혜 전 대통령은 청와대에서 퇴거해 자택으로 발걸음을 옮겼다.

8:0 전원 인용. 이것은 그 누구도 쉽게 예상하기 힘든 결과였다. 탄핵소추안이 국회에서 최종 가결된 작년 12월부터 지난 1월 퇴임한 박한철 전 헌법재판소장과 3월 퇴임한 이정미 전 재판관 소장 대행 등으로 7인 구성의 최종선고가 예측되었기 때문이다. 이번 탄핵심판의 최종선고를 위해 헌법재판소 재판관들은 탄핵소추안이 국회에서 최종 가결된 12월 9일부터 휴일을 제외한 60여 일간 연휴와 주말도 반납한 채 열띤 토론과 검증 작업을 벌였다.

이정미 전 재판관 소장 대행은 헌법재판소 판결문을 통해 탄핵소추안 가결절차와 관련하여 흠결이 있었는지에 대한 여부를 살펴본 후 탄핵사유별로 피청구인의 직무집행에 있어 헌법이나 법률을 위반하였는지를 상세히 살펴보았다. 이정미 전 재판관 소장 대행은 공무원 임명권을 남용하여 직업공무원제도의 본질을 침해하였다는 점에 대해서는 인정하기에 부족하다고 언급했으며, 언론의 자유를 침해하였다는 점에 대해서는 피청구인이 관여하였다고 인정할 만한 증거가 없다고 언급했다. 또한 세월호 사건에 관한 생명권 보호의무와 직책성실의무 위반의 점에 대해서는 헌법상 대통령으로서의 직책을 성실히 수행할 의무를 부담하고 있으나 성실의 개념은 상대적이고 추상적이어서 성실한 직책수행 의무와 같은 추상적 의무규정의 위반을 이유로 탄핵소추를 하는 것은 어렵다고 밝혔다.

그러나 국정개입 허용과 권한 남용 등에 대해서는 헌법, 국가공무원법, 공직자윤리법 등을 위배했으며, 국가공무원법의 비밀엄수의무를 위배했다고 밝혔다. 또한 검찰과 특별검사의 조사에 응하지 않았고 청와대에 대한 압수수색도 거부하는 등 법 위배행위가 반복되지 않도록 할 헌법수호의지가 부족하다고 언급했다. 이에 따라 박근혜 전 대통령은 최종 파면되었으나, 박근혜 전 대통령은 지난달 12일 저녁 "시간이 걸리겠지만 진실은 반드시 밝혀진다고 믿고 있다"며 사실상 헌법재판소의 탄핵 결정에 대해 불복한다는 의사를 밝혔다.

브라질, 에콰도르, 인도네시아, 러시아 등 탄핵 통한 정권 교체 이뤄
다른 국가들의 경우에도 탄핵을 통해 정권이 교체된 경험이 있다. 1992년 브라질의 페르난두 지 멜루 전 대통령은 부정축재 논란으로, 또 작년에는 브라질 역사상 첫 여성 대통령인 지우마 호세프 전 대통령이 재정회계법 위반 혐의로 탄핵되었다. 또한 1997년 에콰도르의 압달라 부카람 전 대통령은 공금횡령 혐의로, 2005년 루시오 구티에레스 전 대통령은 신자유주의 선회에 대한 대중저항으로 탄핵되었다. 그 밖에도 1993년 베네수엘라의 카를로스 안드레스 페레스 전 대통령은 횡령 및 부정축재 혐의로, 2000년 페루의 알베르토 후지모리 전 대통령은 부패 혐의로, 2001년 인도네시아의 압두라만 와히드 전 대통령은 정치적 무능력과 부패 혐의로, 2004년 리투아니아의 롤란다스 팍사스 전 대통령은 러시아 사업가에게 임의로 시민권을 제공한 혐의로, 2012년 파라과이의 페르난도 루고 전 대통령은 경찰과 빈농의 충돌로 17명이 사망한 사건에 대한 책임으로 탄핵되었다.

한편, 미국은 20세기 최악의 정치 스캔들로 손꼽히는 리처드 닉슨 전 대통령의 '워터게이트 사건' 당시 1974년 단핵 결의가 가결되었으며, 닉슨은 자진 사임을 선택했다. 이러한 가운데 박근혜 전 대통령의 파면으로 도널드 트럼프 미국 대통령에 대한 탄핵론이 해외에서 다시 힘을 얻고 있다. 그러나 미국은 정․부통령제와 상․하원 양원제 등으로 한국에 비해 탄핵 절차에 어려움이 있으며, 현실적인 어려움을 무시하고 탄핵을 주장했을 때 정치적인 역풍을 맞을 가능성 역시 배제할 수 없는 상황이다.

The court sacks Park on a unanimous vote
On 10 March 2017 at 11 am, the Korean people wait in silence and uneasiness for the decision of the court on President Park's impeachment. More than 6 months from last October when the influence peddling of Choi Soon-sil was first exposed by The JTBC, the Korean people suffered much from disappointment and anger and they took to the street to call for immediate resignation of the now former president Park which eventually led to impeachment. After 21 minutes of the verdict, the acting chief justice Lee Jung-mi announced the decision made unanimously by the 8 constitutional judges to expel Park from the Blue House. 3 pro-Park protesters died and several injured during the demonstration against the decision on the day. Park left the Blue House on 12 March and went back to her residence in Samseong-dong, Gangnam District, Seoul.

Although many predicted the unanimous decision yet it was hard to be sure and there even was a concern that the decision might be made after the retirement of the acting chief justice Lee Jung-mi which should have left 2 dissenting votes to 5 to drop the case. For the last 60 days, the 8 judges gave up their holidays and weekends in order to focus thoroughly on screening the considerable amount of documents and hearing the testimonies of witnesses on the court. The court found no evidence on the abuse of nomination power which violated the essence of the career civil service system and the infringement on freedom of the press, adding that, the term 'sincerity' in carrying out her duty to control the Sewol ferry disaster was obscure although she was responsible to do her duty sincerely, thus made it hard to be the reasons to impeach her. The courty, however, found her violation of the Constitutional Law, the Government Officials Act and the Public Servant's Ethics that she allowed influence peddling of her confidante Choi Soon-sil and abused power of authority, adding that, she refused investigation of both the prosecutor and the special prosecutor which she promised as well as the search and confiscation of the Blue House, the case which she clearly showed her lack of will in protecting the Constitutional Law. After hearing the unanimous decision, Park on arrival to her residence in Samseong-dong showed her disapproval and said "I believe that the truth will surely be revealed though it will take some time."

The sacked presidents of the world through impeachment
The former president Fernando Collor de Mello was sacked for ill-gotten wealth in 1992 followed by the first woman president Dilma Rousseff for violation of the Finance Law in 2016 in Brazil. In Ecuador, Abdalá Bucaram was sacked for embezzlement of government money in 1997 and Lucio Gutiérrez for changing the course of his political stance to neo-liberalism in 2005. Carlos Andrés Pérez of Venezuela for embezzlement in 1993, Alberto Fujimori of Peru for corruption in 2000, Abdurrahman Wahid of Indonesia for political incompetence and corruption in 2001, Rolandas Paksas of Lithuania for personally giving citizenship to a Russian businessman in 2004, and Fernando Lugo of Paraguay for being responsible on the 17 deaths of the clash between the police and the hunger-stricken farmers were all sacked through impeachment. The watergate scandal in the US in 1974 made Nixon resign himself on passing the impeachment at the US Congress. There is a public sentiment to impeach President Trump in the US but its practicality remains in question mark.
