우리나라 대부분의 국민들은 ‘노동법’이라는 테두리 안에서 살아가고 있다. 하지만 정작 노동법이 가진 구체적인 내용에 대해서는 잘 모르는 경우가 많다. 국민들이 가지고 있는 법의식 수준이 아직 미약하기 때문에 노동법에 대한 이해가 전반적으로 부족하게 된 것이다. 게다가 시대가 변화함에 따라 법제도가 발전하고 있고, 이와 더불어 노사관계를 다루는 노동법도 다양하게 변모하고 있기 때문에 노동법에 대한 심화된 지식을 갖춘 전문가의 존재는 더 없이 중요하다.

노동분쟁 해결을 위한 최적의 솔루션

강원지사장을 맡고 있는 김양경 노무사는 “노동분쟁은 언뜻 근로자와 회사 간에 일어난 문제로 생각하기 쉽습니다. 하지만 그 안을 들여다보면 대부분 고용주와 피고용자 즉, ‘사람’과 ‘사람’ 사이에 발생한 분쟁인 경우가 많죠. 그 가운데서 적절한 개입과 조정을 통해 중재를 이끌어 내는 것이 노무사의 중요한 역할이라고 생각합니다”라고 말했다. 그런 점에서 그녀가 가진 ‘여성 노무사’로서의 섬세하고 부드러운 일처리는 많은 이들에게 큰 호응을 받고 있다. 단순히 겉으로 표출된 현상 뿐 아니라 그 내면에 있는 분쟁 당사자들의 마음을 이해하는 것이 그들의 상처를 보듬고, 보다 만족할 수 있는 결과를 이끌어낸다는 생각이다.

김양경 노무사의 또 다른 강점은 일에 대한 열정이다. 배움에 대한 열정으로 지금도 끊임없이 다양한 판례와 사건들을 공부하고 있다는 김 노무사는 남들이 소위 ‘돈이 되지 않는다’, ‘이기기 어렵다’라고 말하며 거절하는 사건들도 이를 통해 더욱 성장하는 계기가 된다면 수임을 마다하지 않는다고 한다. 다양한 경험을 갖는 것이 훌륭한 노무사가 되기 위한 첫걸음이라고 말하는 그녀는 강원지방노동위원회에서 국선노무사로 활동하기도 하며 더욱 많은 사람들을 만나고 그들의 이야기를 듣기 위해 노력하고 있다. 

김 노무사는 노무 분쟁 해결에 있어서 노무사가 균형적인 시각을 유지하는 것이 무척이나 중요하다고 강조했다. 이에 더해 노무사에게 소송대리권이 없기 때문에 발생하는 문제들에 대한 개선책도 필요하다고 덧붙였다. 또한 원주시에도 시민고충처리위원회에 보다 시민에게 가깝게 다가갈 수 있는 별도의 노동 분야를 마련해 취약계층 근로자에게 도움을 주길 바란다는 의견을 밝혔다.

노무사는 사람들의 생계의 기반이자 하루 중 대부분의 시간을 쏟는 일터에서 일어나는 일들을 다루는 직업이다. 때문에 사람들이 살아가는 방식에 큰 영향을 끼치는 것은 물론이고 우리 사회가 나아가야 할 올바른 방향을 제시하는 중요한 역할을 한다. 항상 고민하고 성장하는 자세로 ‘믿을 수 있는 노무사’, ‘검증된 실력을 갖춘 노무사’가 되고 싶다는 그녀. 가야노무법인과 김양경 노무사가 건전한 노무관계 확립과 건강한 기업생태계 확립에 큰 역할을 할 수 있게 되기를 기대한다.

Gaya Labor Service was established in 2002 and has been growing as a main corporate body in the field by providing professional services and consultation for labor disputes. They opened Gangwon branch in Wonjun in 2012 and is offering a one-stop legal service. Kim says "labor disputes are regarded as disputes between employees and employer but it actually is about disputes between people. Our role is to arbitrate in the dispute with appropriate measures." In that terms, her delicate and smooth dispose of the matter is drawing a great deal of attention. Producing good results is important for her but equally so is to take the matter as her own problem because in that way, she believes, she can bind up the mental and emotional wounds of her clients also. 

Winning clients' confidence with professionalism and unbiased advice
Kim is passionate about her job. She never stops researching on various cases and judicial precedents and willingly takes the cases that might not bring her winning in court or profits as long as they can be momentums for her to grow. Kim says that to have a variety of experiences is the fist step to take for a great labor attorney and for this reason, she is also being active as a public defender at Gangwon Labor Relation Commission. Kim emphasizes unbiased advice to solve a dispute effectively. She also mentioned that certain measures from both parties regarding the dispute are needed as labor attorneys do not have authority of legal representation. In addition, she has asked Wonju city to open a labor department so that workers from socially disadvantaged class can have a systematic help. The role of labor attorneys in our society is very important as they are the ones who can effectively solve the disputes between labor and management. It means that they affect the way we live and suggest a right direction of our society.
