특허경영 시대, 기업 경영 특허정보전략으로 뚫자!

특허를 무기로 치열한 싸움이 벌어지는 ‘특허전쟁’의 시대. 기술이 곧 경쟁력인 기업들은 ‘특허경영’에 관심을 돌리고 있다. 지적재산권을 활용한 경영으로 부가가치를 창출하는 것이 창조경제의 새로운 모델이 되고 있기 때문이다. 기업의 자산구조도 실물자산에서 기술자산으로 변화되고 있는 만큼 이제는 지식재산을 경영할 때이다.

신원국제특허법률사무소의 허성원 대표변리사는 ‘특허는 기업의 비전’이라고 말한다. 한 기업의 특허 현황을 들여다보면 그 기업의 과거와 현재, 미래가 보이며, 그 기업이 왜 존재하고 무엇이 되고자 하며 어떻게 경영하고 있는지(why, what, how)를 읽을 수 있다는 것이다. 이같이 특허정보는 해당 기업이 현재까지 존속해온 생존 역량과 지속가능한 성장 역량을 가늠할 수 있는 중요한 지표가 되고, 업계나 시장으로 확장해서 보면 기업의 경쟁 환경과 시장의 변화 트렌드의 지표가 된다. 그래서 경영자의 특허마인드 즉 특허경영 의지는 기업의 존속과 성장 가능성을 결정하는 중요한 요소가 되었다고 강조했다.

삼성전자를 비롯한 국내외 다수 기업의 특허 출원 및 분쟁 업무를 맡아 온 그는 엔지니어  연구원으로서 기업에 근무하다 변리사에 뜻을 두어 특허업계에 입문한지 25년 이상을 특허분야 현업에 종사해온 베테랑이다. 그는 최근 그동안의 특허 업무 경험과 경영 및 인문학에 대한 학습을 토대로 ‘특허 전략경영’ 등에 관해 기업 강의와 컨설팅 활동을 하고 있다. 또 내년 신원국제특허법률사무소의 20주년을 맞이해 특허와 경영, 인문학이 접목된 책도 펴낼 예정이다. 24시간이 모자랄 만큼 동분서주 열정적인 활약을 보이고 있는 그는 운영하는 SNS도 3개나 된다. 블로그, 트위터, 페이스북을 통해 특허로 하는 국제 경영과 일반인은 물론 기업의 총책임자도 알지 못하는 특허 경영의 철학적인 관점을 알리는데 노력하고 있다.

“남의 화살로 싸워라.” 

그의 사무실에 적혀 있는 이 글귀는 타인의 권리를 침해하지 않는 범위에서 창조적인 모방이 필요하다는 것을 말하고 있다. 

“흔히들 특허권을 확보해서 기술을 모방하는 기업에 제제를 가하고 시장에서 우월적 지위를 갖는 것이 특허권의 기본적인 목적이라고 생각합니다. 그런데 사실 특허제도가 왜 있는가를 가만히 생각해보면 기술을 발명한 사람의 권리를 보호해주는 것만 아니라 남의 특허를 잘 모방하라는 것에 있습니다”

남의 특허를 침해하지 않는 모방은 성공의 열쇠가 되기도 한다는 허성원 변리사는 지금도 많은 연구개발 현장은 관련업계의 특허를 분석하는 것에서 출발한다고 말하며 공개된 수많은 특허들 속에서 시행착오를 거치며 배우고 진보하여 더 경쟁력 있는 제품을 만들고 기술을 개발시켜 나갈 수 있다고 강조했다.

"CEO 들이여 '특허통수권'을 가져라"

앞서 말했듯 특허전쟁의 시대라 해도 과언이 아닐 만큼 특허를 둘러싼 경쟁은 날로 치열해 지고 있다. 그럼에도 기업에서 특허권을 관리하는 사람은 여전히 ‘담당 직원’ 이다. 이에 대해 허성원 변리사는 기업의 오너가 경영마인드로 갖는 특허에 관한 미비한 인식을 강화하고 특허권을 직접 관리해야 한다고 주장한다. 그는 이를 가리켜 ‘특허통수권’이라 칭했다. 전쟁에 있어 전시작전통수권이 필요하듯이 특허전쟁 속에서 기업의 총 책임자가 기업의 전략으로써 특허통수권을 가져야 한다는 것이다. 다시 말해 특허를 통해 경영환경을 이해하고 대처하며 극복할 방안을 마련한다는 것이다. 어느 기업도 쉽사리 자사의 핵심 전략을 알려주지 않는다. 허성원 변리사는 이것을 파악하는데 가장 좋은 방법이 특허를 이해하는 것이라고 말한다.

“우리가 한 기업을 이해하기 위해선 여러 방법이 있지만 특허내용만 잘 봐도 이 기업은 과거에는 무엇을 했었고, 현재는 무엇을 하고 있고, 미래는 무얼 할지 파악할 수 있죠. 구두닦이가 손님의 구두를 보면 성격을 알 수 있다는 것처럼, 기업은 특허를 보면 상당부분 알 수 있습니다. 집단 창의력은 어느 정도 되는지, 연구는 활발히 이뤄지고 있는지. 기업의 미래가 밝으려면 연구가 계속적으로 일어나야 하는데 기업의 연구원들이 앞 다퉈 연구개발 한다면 그 기업은 앞날이 밝은 것이겠죠. 이 처럼 특허는 기업을 진단하고 나아갈 방향을 설정해 줍니다. 뿐만 아니라 기업의 건강한 철학을 정립하는데도 도움이 되죠.” 하지만 특허를 전략적으로 활용하지 못하는 기업이 많은 것이 아쉽다는 허성원 변리사는 특허만 제대로 활용해도 이상적인 기업의 환경을 만들 수 있다고 조언했다.

The age of patent management, let us go through with patent information strategy 

It is the age of patent war with patent as its weapon. For those companies whose technology means competitiveness is turning to 'patent management'. To create additional value by using intellectual property is becoming a new model of creative economy. As the asset structure of a company is being changed from actual asset to technical asset, it is time to manage intellectual property. 

Sungwon Huh, the representative patent attorney of Shinwon Patent & Law Firm said "patent is the vision of a company". It means that we can see the past, the present and the future of a company as well as why the company exists, what kind of company it wants to be and how they are running it (why, what, how) by looking at the existing state of a company's patent. Such patent information can be an important barometer to weigh up a company's long lasting survival capacity and the sustainable growth capacity, as well as the barometer of competition environment of a company and the changes of market in the industry and market's perspectives. Huh emphasized that the CEO's willpower of patent-mined (patent management) is the core element to decide whether the company will grow or fall. Lee, who worked as an engineer researcher, has been a veteran patent attorney for 25 years and has worked for Korea's large cooperations such as Samsung responsible for patent applications and disputes. Now, he is active on lecturing and consulting for companies about 'patent strategy management' by using his knowledge and experience working in the field. Huh is expected to publish a book which will contain patent, management and the humanities next year on the occasion of Shinwon Patent & Law Firm's 20th birthday. Despite his busy schedules he is running 3 SNS. Through his blog, twitter and facebook, Huh is giving people and companies information on philosophical perspectives of patent.  

"Fight with enemy's arrow."

The phrase, which is hung on the wall of his office, tells that the creative imitation is needed within the scope of not violating other people's rights. It means that the patent system's strategic reason of being is 'to reveal technology' and we have to understand patent system in a new perspective.

"People think that the purpose of patent rights is to take an advantageous position in the market and to punish those who copy. But if we think careful why there is a patent system, we can see that it is to protect the rights of one who invented as well as to imitate it."

Huh emphasized that as long as we do not violate other's patent it can be a key to succeed. R&D starts from analysing the related industry's patent and through this we can learn and try and invent our own patent.

"CEOs! Have the prerogative of supreme command on patent"

The competition over patent is getting fierce day by day. Nevertheless, the person who deals with patent is only 'the person in charge'. Huh said firmly that the owner of a company should manage and reinforce patent himself. Huh named this as 'the prerogative of supreme command on patent'. As a prerogative of supreme command is needed in the war, so does in patent. In other the words, the commander understands the management environment and draws up measures through patent. No company reveals their core strategies. Understanding about patent is the best way to figure that out.

"There are many ways to know about a company. But we can understand what they did, what they are doing now, and what they will do by looking through the patent they have. Like a shoeshine sees what kind of person he is when he saw his customer's shoes, the same applies to a company. If a company wants to have a bright future, they need to investigate how much collective ingenuity they have and whether they do researches actively.  If their research workers compete in R&D, the company surely can have a bright future. Patent not only gives a company a diagnosis and the direction they have to turn but also helps establish a healthy philosophy of a company." However, there are still many companies which do not know how to make use of it. Huh advised that if a company can take advantage of patent, they can make an ideal work environment.
