Power Korea Monthly interviewed Heo Haeng-seok, a veteran judicial scrivener representing the area of Dongdaemoon-gu to hear his analysis of the status quo and lucid advice as a person in charge.


Judicial scrivener Heo¡¯s diagnosis and analysis 

on the current real property market

Heo Haeng-seok Legal Office lies in the tax accounting center Mijoo on the northeast part of Seoul. Judicial scrivener Heo known for free legal counsel, legal affair service and lecture activity opened his office in November 1996 because he passed the 3rd judicial scrivener exam after leaving the military service. The office is basically dealing with ownership transfer registration pursuant to real property trade, preparation of contract note and transaction report. In relation to household matters, they often deal with inheritance by agreed partition among dead families, legal inheritance registration, preparation of donation document and inheritance registration by a will. Besides, the office is in charge of arranging a loan for community credit cooperative free of charge in connection to financial institutions and registration of their fixed collateral. Lately with disappearance of minimum capital provision for registering joint-stock company, it has become possible with 100,000 to 1,000,000 won along with an increasing number of jobs of changing the company representative¡¯s address and officers or capital increase. Scrivener Heo said that one-man company is possible with a capital of less than one billion won and that there are many consultations for transforming into one-man company from the existing corporation by processing to resign an officer out of reach. Located where there are many specialists in tax accounting, Heo¡¯s legal office receives more cases of realty auction application compared to other offices and is in charge of exclusion of false hirer¡¯s apportionment, appeal for apportionment opposition and claim analysis, laying a suit for returning undue profit on wrong apportionment, instruction on auction and free public sale bid and vicarious execution. Regarding the recent trend of realty, he analyzed, ¡°As of the end of 2013, urgent offerings were almost sold up and now it is starting or entering the up-phase of real property. One thing, there is a lack of interest in buying residential real estate. However, with a low-interest base keeping and stock market dull, end users to buy realty and brimming floating funds are going to be purchase funds. In case of action for foreigner¡¯s denizenship, it is going to put up the prices of realty. So now is the good time for buying real estate.¡± Currently, there are tenants feeling tired of rising deposits who want to own a house, so demand for purchase is considered to rise up. On this opportunity, he thinks that it will activate the real estate market if the government supports low-interest loan for the first-time-in-life buyers and residential home buyers and increase application of LTV and DTI by policy, and building companies are taking charge of discounting unsold apartments and sharing loan money. Scrivener Heo is also thinking that, by deducting the loan interest of transfer income tax, it will increase the ratio of house purchase for the case of tenants. He repeatedly asks customers, ¡°In case after signing sales or rental agreement and then the contract is terminated by either of the parties¡¯ non-fulfillment, you cannot forfeit or request directly for damages. For instance, the seller should send a notice to buyer who fails to give the remainder in relation to transfer of ownership. In case a seller fails to send off a notice to a buyer who neglects to give the remainder but processes it by phone or orally to sell it to a third party, the seller may have to be held doubly responsible as a double seller. So for cancellation of trade and rental contract, you should consult a specialist and then send a notice.¡± Besides, scrivener Heo emphasized from many cases that, if lending money on the collateral of the signing of rental agreement, increased money of deposit and real estate in registering fixed collateral, temporary registration, etc. one should receive the evidence of full payment for national tax and local tax from the realty owner to see if there is unpaid taxes, in order not to suffer a loss. 


Want a world in which honest realty tax payers are respected 

with Dongdaemun-gu reborn as a startup cradle      

Scrivener Heo is giving a lecture at Imoon Culture and Sports Center on the guide of auction and livelihood law which is not easily understood to the public. For the 8-week course, he explains stage by stage the process, kinds, terminology and claim analysis of auction, concepts and related matters of house lease protection act and commercial building lease protection act, lien and tribunal sovereignty, definition of tomb base right, diverse cases of other auction-related process, participation and differences of public sale and auction, fixed collateral transfer, notice of cession/nullification of an obligation and purchase of insolvent obligation, acquisition and trade of real estate, inheritance and realty-related taxes. He also has a bid prepared to offer auction weekly and reviews to help one write it on his own after the training. Scrivener Heo receives many questions about a lessee who doesn¡¯t pay monthly rental and conversely about the owner who doesn¡¯t return deposit even after the termination of a rental term, so gives counseling on related rental registration decree, lawsuit, auction, etc. He also gives much information on the process of provisional seizure, suit and auction process, etc. when lending money to another person without receiving an IOU. Regarding the current commercial law, scrivener Heo said it deals a lot with each kind of alteration registry including incorporation of a juristic person and has merits such as relived restriction of capital, possible proof of balance with private person¡¯s bankbook, simplified registry of corporation through no need for authentication of articles of association. But he added, ¡°Since the operators in Seoul are taken charge of by one place, Seoul Central District Court registry at Seocho-gu, one must go there in person even for a simple alteration of address. I hope all registries can process commercial registrations in the future.¡± His solution for activating the real estate market is a new redevelopment policy for reducing the gap between north and south of the Han River. He is donating to redevelopment association on the condition of widening the road. If the state and local government provide the site for road and river for free and purchase the rest area from the association, it will result in reducing the charge of the members and increasing the nonofficial redevelopment. Broadening the road through this and cleaning up the mess of the city, I expect it will help urban environment greatly. Besides, he indicated that there is not one knowledge industry center though Dongdaemun-gu has many fine universities and the state¡¯s research institutes. So he thinks that when Korea Rural Economic Institute at Hoigi-dong moves, we could build Knowledge Industry Center at that place and student, professor and researcher start up as mentor and mentee it could create jobs and help the growth of Dongdaemun-gu. Lastly, he also indicates the prejudice of those who register realty. They are giving a tremendous amount of taxes to the state and local government from a heavy amount of acquisition tax, stamp duty, Supreme Court stamp tax and purchase of housing bond simply because they are real property owner with many houses. So he added that, if only they pay taxes sincerely, they are worth calling a patriot not wrong moneymaker.
